MPS and DPL comment on the draft Health Care and Associated Professions (Indemnity Arrangements) Order 2013

We have welcomed the government’s proposed approach to transposing into UK law the EU requirement for healthcare professionals to have an indemnity arrangement in place.
An obligation will be placed on healthcare professionals to ensure that any indemnity arrangement in place is appropriate to their duties, scope of practice, and to the nature and extent of the risk. We have emphasised the importance of healthcare professionals fully disclosing the nature, scope and extent of their practice to their indemnity provider and have said that full disclosure must occur both at the time of taking out indemnity protection and whenever the scope of their practice changes.
We have suggested that, for the new arrangements to be successful, regulators must invest in regular promotion of the requirement for indemnity to registrants and spread awareness amongst patients and the public. They should also make it clear to registrants that they must fulfil this responsibility for full disclosure.
